حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ لاَ يَمْنَعْ أَحَدُكُمْ فَضْلَ مَاءٍ لِيَمْنَعَ بِهِ الْكَلأَ

It was narrated from Abu Hurairah that the Prophet (ﷺ) said: “No one of you should withhold surplus water from common pastureland.”

It was narrated from Aishah that the Messenger of Allah (ﷺ) said: “Surplus water should not be withheld, and neither should surplus water from a well.

حَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ، أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، عَنْ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ، أَنَّ رَجُلاً، مِنَ الأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرَّ فَأَبَى عَلَيْهِ فَاخْتَصَمَا عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ فَغَضِبَ الأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللَّهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللَّهِ صلى الله عليه وسلم ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ قَالَ فَقَالَ الزُّبَيْرُ وَاللَّهِ إِنِّي لأَحْسَبُ هَذِهِ الآيَةَ أُنْزِلَتْ فِي ذَلِكَ ‏{‏فَلاَ وَرَبِّكَ لاَ يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لاَ يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا‏}‏‏.‏

It was narrated from 'Abdullah bin Zubair that : a man from among the Ansar had a dispute with Zubair in the presence of the Messenger of Allah (ﷺ) concerning the streams of the Harrah with which he irrigated his palm trees. The Ansari said: “Let the water flow,” but he refused. So they referred their dispute to the Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) said: “Irrigate (your trees) O Zubair, then let the water flow to your neighbor.” The Ansari became angry and said: “O Messenger of Allah (ﷺ), is it because he is your cousin (son of your paternal aunt)?” The expression of the Messenger of Allah (ﷺ) changed, then he said: “O Zubair, irrigate (your trees) then retain the water until it reaches the walls.” Zubair said: “I think this Verse was revealed concerning that: “But no, by your Lord, they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission [1].'” (Sahih) [1] An-Nisa 4.65

حَدَّثَنَا إِبْرَاهِيمُ بْنُ الْمُنْذِرِ الْحِزَامِيُّ، حَدَّثَنَا زَكَرِيَّا بْنُ مَنْظُورِ بْنِ ثَعْلَبَةَ بْنِ أَبِي مَالِكٍ، حَدَّثَنِي مُحَمَّدُ بْنُ عُقْبَةَ بْنِ أَبِي مَالِكٍ، عَنْ عَمِّهِ، ثَعْلَبَةَ بْنِ أَبِي مَالِكٍ قَالَ قَضَى رَسُولُ اللَّهِ صلى الله عليه وسلم فِي سَيْلِ مَهْزُورٍ الأَعْلَى فَوْقَ الأَسْفَلِ يَسْقِي الأَعْلَى إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسِلُ إِلَى مَنْ هُوَ أَسْفَلُ مِنْهُ

It was narrated that Tha'labah bin Abu Malik said: “The Messenger of Allah (ﷺ) ruled concerning the stream of Mahzur that the higher ground took precedence over the lower, so the higher ground should be irrigated until the water reached the ankles, then it should be released to those who were lower.

حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ، أَنْبَأَنَا الْمُغِيرَةُ بْنُ عَبْدِ الرَّحْمَنِ، حَدَّثَنِي أَبِي، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِي سَيْلِ مَهْزُورٍ أَنْ يُمْسِكَ حَتَّى يَبْلُغَ الْكَعْبَيْنِ ثُمَّ يُرْسِلَ الْمَاءَ

It was narrated from 'Amr bin Shu`aib, from his father, from his grandfather, that : the Messenger of Allah (ﷺ) ruled concerning the stream of Mahzur that the water should be retained until it reached the ankles, then released.

حَدَّثَنَا أَبُو الْمُغَلِّسِ، حَدَّثَنَا فُضَيْلُ بْنُ سُلَيْمَانَ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ، عَنْ إِسْحَاقَ بْنِ يَحْيَى بْنِ الْوَلِيدِ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِي شُرْبِ النَّخْلِ مِنَ السَّيْلِ أَنَّ الأَعْلَى فَالأَعْلَى يَشْرَبُ قَبْلَ الأَسْفَلِ وَيُتْرَكُ الْمَاءُ إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسَلُ الْمَاءُ إِلَى الأَسْفَلِ الَّذِي يَلِيهِ وَكَذَلِكَ حَتَّى تَنْقَضِيَ الْحَوَائِطُ أَوْ يَفْنَى الْمَاءُ ‏.‏

It was narrated from 'Ubadah bin Samit that : the Messenger of Allah (ﷺ) ruled concerning the irrigation of palm trees from streams, that the higher ground should be irrigated before the lower, and that the water should be allowed to reach the ankles, then released to flow the nearest lower ground, and so on, until all the fields were watered or until the water ran out.

حَدَّثَنَا إِبْرَاهِيمُ بْنُ الْمُنْذِرِ الْحِزَامِيُّ، أَنْبَأَنَا أَبُو الْجَعْدِ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ، عَنْ كَثِيرِ بْنِ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ يُبْدَأُ بِالْخَيْلِ يَوْمَ وِرْدِهَا ‏‏ ‏.‏

It was narrated from Kathir bin 'Abdullah bin 'Amr bin 'Awf Al-Muzani, from his father, that his grandfather said: “The Messenger of Allah (ﷺ) said: 'Start with the horses on the day that you bring (the animals to drink).' ”

حَدَّثَنَا الْعَبَّاسُ بْنُ جَعْفَرٍ، حَدَّثَنَا مُوسَى بْنُ دَاوُدَ، حَدَّثَنَا مُحَمَّدُ بْنُ مُسْلِمٍ الطَّائِفِيُّ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي الشَّعْثَاءِ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ كُلُّ قَسْمٍ قُسِمَ فِي الْجَاهِلِيَّةِ فَهُوَ عَلَى مَا قُسِمَ وَكُلُّ قَسْمٍ أَدْرَكَهُ الإِسْلاَمُ فَهُوَ عَلَى قَسْمِ الإِسْلاَمِ ‏‏ ‏.‏

It was narrated from Ibn `Abbas that the Messenger of Allah (ﷺ) said: “Every division that was allocated according to (the rules of) the Ignorance days, stands as it is, and every division that was allocated according to (the rules of) Islam, stands according to the rules of Islam.”

حَدَّثَنَا الْوَلِيدُ بْنُ عَمْرِو بْنِ سُكَيْنٍ، حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْمُثَنَّى، ح وَحَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ الصَّبَّاحِ، حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، قَالاَ حَدَّثَنَا إِسْمَاعِيلُ الْمَكِّيُّ، عَنِ الْحَسَنِ، عَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ ‏ مَنْ حَفَرَ بِئْرًا فَلَهُ أَرْبَعُونَ ذِرَاعًا عَطَنًا لِمَاشِيَتِهِ ‏‏ ‏.‏

It was narrated from 'Abdullah bin Mughaffal that the Prophet (ﷺ) said: “Whoever digs a well, is entitled to forty forearms' length surrounding it is as a resting place for his flocks.”

حَدَّثَنَا سَهْلُ بْنُ أَبِي الصُّغْدِيِّ، حَدَّثَنَا مَنْصُورُ بْنُ صُقَيْرٍ، حَدَّثَنَا ثَابِتُ بْنُ مُحَمَّدٍ، عَنْ نَافِعٍ أَبِي غَالِبٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ حَرِيمُ الْبِئْرِ مَدُّ رِشَائِهَا ‏‏ ‏.‏

It was narrated from Abu Sa'eed Al-Khudri that the Messenger of Allah (ﷺ) said: “The land around a well (that is considered to be part of it) is the length of the well rope (in all directions).”

حَدَّثَنَا عَبْدُ رَبِّهِ بْنُ خَالِدٍ النُّمَيْرِيُّ أَبُو الْمُغَلِّسِ، حَدَّثَنَا الْفُضَيْلُ بْنُ سُلَيْمَانَ، حَدَّثَنَا مُوسَى بْنُ عُقْبَةَ، أَخْبَرَنِي إِسْحَاقُ بْنُ يَحْيَى بْنِ الْوَلِيدِ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِي النَّخْلَةِ وَالنَّخْلَتَيْنِ وَالثَّلاَثَةِ لِلرَّجُلِ فِي النَّخْلِ فَيَخْتَلِفُونَ فِي حُقُوقِ ذَلِكَ فَقَضَى أَنَّ لِكُلِّ نَخْلَةٍ مِنْ أُولَئِكَ مِنَ الأَرْضِ مَبْلَغُ جَرِيدِهَا حَرِيمٌ لَهَا ‏.‏

It was narrated from 'Ubadah bin Samit that : the Messenger of Allah (ﷺ) ruled concerning one, two or three date palms belonging to a man among other palm trees - when they differ concerning entitlement to the surrounding land. He ruled that the land around each of those trees, as far as their leaves reach, measured from the bottom of the tree, belongs to the owner of the tree.

حَدَّثَنَا سَهْلُ بْنُ أَبِي الصُّغْدِيِّ، حَدَّثَنَا مَنْصُورُ بْنُ صُقَيْرٍ، حَدَّثَنَا ثَابِتُ بْنُ مُحَمَّدٍ الْعَبْدِيُّ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ حَرِيمُ النَّخْلَةِ مَدُّ جَرِيدِهَا ‏‏ ‏.‏

It was narrated from Ibn 'Umar that the Messenger of Allah Said: “The land around a date-palm tree, as far as its branches reach, belongs to the owner of the tree.”

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، وَعَمْرُو بْنُ رَافِعٍ، قَالاَ حَدَّثَنَا مَرْوَانُ بْنُ مُعَاوِيَةَ، حَدَّثَنَا أَبُو مَالِكٍ النَّخَعِيُّ، عَنْ يُوسُفَ بْنِ مَيْمُونٍ، عَنْ أَبِي عُبَيْدَةَ بْنِ حُذَيْفَةَ، عَنْ أَبِيهِ، حُذَيْفَةَ بْنِ الْيَمَانِ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ بَاعَ دَارًا وَلَمْ يَجْعَلْ ثَمَنَهَا فِي مِثْلِهَا لَمْ يُبَارَكْ لَهُ فِيهَا ‏‏ ‏.‏

It was narrated from Hudhaifah bin Yaman that the Messenger of Allah (ﷺ) said: “Whoever sells a house and does not use the money for something similar, will not to be blessed therein.' ”

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، وَمُحَمَّدُ بْنُ الصَّبَّاحِ، قَالاَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ كَانَتْ لَهُ نَخْلٌ أَوْ أَرْضٌ فَلاَ يَبِيعُهَا حَتَّى يَعْرِضَهَا عَلَى شَرِيكِهِ ‏‏ ‏.‏

It was narrated that Jabir said: “The Messenger of Allah (ﷺ) said: 'Whoever has a date-palm tree or land, should not sell it until he has offered it to his partner.' ”

حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ، وَالْعَلاَءُ بْنُ سَالِمٍ، قَالاَ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا شَرِيكٌ، عَنْ سِمَاكٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ ‏ مَنْ كَانَتْ لَهُ أَرْضٌ فَأَرَادَ بَيْعَهَا فَلْيَعْرِضْهَا عَلَى جَارِهِ ‏‏ ‏.‏

It was narrated from Ibn Abbas that the Prophet (ﷺ) said: “Whoever has land and wants to sell it, let him offer it to his neighbor.”

Loading hadith 2513

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا هُشَيْمٌ، أَنْبَأَنَا عَبْدُ الْمَلِكِ، عَنْ عَطَاءٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ الْجَارُ أَحَقُّ بِشُفْعَةِ جَارِهِ يَنْتَظِرُ بِهَا إِنْ كَانَ غَائِبًا إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا ‏‏ ‏.‏

It was narrated from Jabir that the Messenger of Allah (ﷺ) said: “The neighbor has more right to preemption of his neighbor, so let him wait for him even if he is absent, if they share a path.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَعَلِيُّ بْنُ مُحَمَّدٍ، قَالاَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ، عَنْ عَمْرِو بْنِ الشَّرِيدِ، عَنْ أَبِي رَافِعٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ ‏ الْجَارُ أَحَقُّ بِسَقَبِهِ ‏‏ ‏.‏

It was narrated from Abu Rafi' that the Prophet (ﷺ) said: “The neighbor has more right to property that is near.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ حُسَيْنٍ الْمُعَلِّمِ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ عَمْرِو بْنِ الشَّرِيدِ بْنِ سُوَيْدٍ، عَنْ أَبِيهِ الشَّرِيدِ بْنِ سُوَيْدٍ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أَرْضٌ لَيْسَ فِيهَا لأَحَدٍ قِسْمٌ وَلاَ شِرْكٌ إِلاَّ الْجِوَارُ ‏.‏ قَالَ ‏ ‏ الْجَارُ أَحَقُّ بِسَقَبِهِ ‏‏ ‏.‏

It was narrated that Sharid bin Suwaid said: “I said: 'O Messenger of Allah, (what do you think of) land owned by only one person but this land has neighbors?' He said: 'The neighbor has more right to property that is near.' ”

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْجَرَّاحِ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ، عَنْ عَمْرِو بْنِ الشَّرِيدِ، عَنْ أَبِي رَافِعٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ الشَّرِيكُ أَحَقُّ بِسَقَبِهِ مَا كَانَ ‏‏ ‏.‏

It was narrated from Abu Rafi' that the Messenger of Allah (ﷺ) said: “The partner has more right to what is near him, so long as he is still a partner.”

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ إِنَّمَا جَعَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم الشُّفْعَةَ فِي كُلِّ مَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلاَ شُفْعَةَ ‏"‏ ‏.‏

It was narrated from Jabir bin Abdullah that: the Messenger of Allah (ﷺ) ruled that preemption takes effect in all cases where land has not been divided. But if the boundaries have been set and the roads laid out, then there is no preemption.”

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ الْحَارِثِ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ، عَنْ أَبِيهِ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ الشُّفْعَةُ كَحَلِّ الْعِقَالِ ‏‏ ‏.‏

It was narrated from Ibn 'Umar that the Messenger of Allah (ﷺ) said: “Preemption is like undoing the `Iqal.”

حَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ، قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ الْحَارِثِ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ، عَنْ أَبِيهِ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ لاَ شُفْعَةَ لِشَرِيكٍ عَلَى شَرِيكٍ إِذَا سَبَقَهُ بِالشِّرَاءِ وَلاَ لِصَغِيرٍ وَلاَ لِغَائِبٍ ‏‏ ‏.‏

It was narrated from Ibn 'Umar that the Messenger of Allah (ﷺ) said: “There is no preemption for a partner when his co-partner has beaten him to it (in another deal before), not for a minor nor one who is absent.”

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنِ الْحَسَنِ، عَنْ مُطَرِّفِ بْنِ عَبْدِ اللَّهِ بْنِ الشِّخِّيرِ، عَنْ أَبِيهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ ضَالَّةُ الْمُسْلِمِ حَرَقُ النَّارِ ‏‏ ‏.‏

It was narrated from Mutarrif bin 'Abdullah bin Shikhkhir that his father said: “The Messenger of Allah (ﷺ) said: 'The lost animal of the Muslim may lead to the burning flame of Hell.' ”

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، حَدَّثَنَا أَبُو حَيَّانَ التَّيْمِيُّ، حَدَّثَنَا الضَّحَّاكُ، خَالُ الْمُنْذِرِ بْنِ جَرِيرٍ عَنِ الْمُنْذِرِ بْنِ جَرِيرٍ، قَالَ كُنْتُ مَعَ أَبِي بِالْبَوَازِيجِ فَرَاحَتِ الْبَقَرُ فَرَأَى بَقَرَةً أَنْكَرَهَا فَقَالَ مَا هَذِهِ قَالُوا بَقَرَةٌ لَحِقَتْ بِالْبَقَرِ ‏.‏ قَالَ فَأَمَرَ بِهَا فَطُرِدَتْ حَتَّى تَوَارَتْ ثُمَّ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ ‏ لاَ يُئْوِي الضَّالَّةَ إِلاَّ ضَالٌّ ‏‏ ‏.‏

It was narrated that Mundhir bin Jarir said: “I was with my father in Bawazij and the cows came back in the evening. He saw a cow did not recognize it. He said: 'What is this?' He said: 'A cow that joined the herd.' And he issued orders that it be driven away until it disappeared from view. Then he said: 'I heard the Messenger of Allah (ﷺ) say: “No one gives refuge to a stray animal but one who is also astray.”

حَدَّثَنَا إِسْحَاقُ بْنُ إِسْمَاعِيلَ بْنِ الْعَلاَءِ الأَيْلِيُّ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ يَزِيدَ، مَوْلَى الْمُنْبَعِثِ عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، فَلَقِيتُ رَبِيعَةَ فَسَأَلْتُهُ فَقَالَ حَدَّثَنِي يَزِيدُ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ سُئِلَ عَنْ ضَالَّةِ الإِبِلِ فَغَضِبَ وَاحْمَرَّتْ وَجْنَتَاهُ وَقَالَ ‏"‏ مَالَكَ وَلَهَا مَعَهَا الْحِذَاءُ وَالسِّقَاءُ تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا ‏"‏ ‏.‏ وَسُئِلَ عَنْ ضَالَّةِ الْغَنَمِ فَقَالَ ‏"‏ خُذْهَا فَإِنَّمَا هِيَ لَكَ أَوْ لأَخِيكَ أَوْ لِلذِّئْبِ ‏"‏ ‏.‏ وَسُئِلَ عَنِ اللُّقَطَةِ فَقَالَ ‏"‏ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا وَعَرِّفْهَا سَنَةً فَإِنِ اعْتُرِفَتْ وَإِلاَّ فَاخْلِطْهَا بِمَالِكَ ‏"‏ ‏.‏

It was narrated from Zaid bin Khalid that the Prophet (ﷺ) was asked about a lost camel. : He turned red, and he said: “What does it have to do with you? It has its feet and its water supply, it can go and drink water and eat from the trees until its owner finds it.” And he was asked about lost sheep, and he said: “Take it, for it will be for you or for your brother or for the wolf.” And he was asked about lost property and he said: “Remember the features of its leather bag and strap, and announce it for one year, then if someone claims it, describing it to you with those features (give it to him), otherwise incorporate it into your own wealth.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ، عَنْ خَالِدٍ الْحَذَّاءِ، عَنْ أَبِي الْعَلاَءِ، عَنْ مُطَرِّفٍ، عَنْ عِيَاضِ بْنِ حِمَارٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ وَجَدَ لُقَطَةً فَلْيُشْهِدْ ذَا عَدْلٍ أَوْ ذَوَىْ عَدْلٍ ثُمَّ لاَ يُغَيِّرْهُ وَلاَ يَكْتُمْ فَإِنْ جَاءَ رَبُّهَا فَهُوَ أَحَقُّ بِهَا وَإِلاَّ فَهُوَ مَالُ اللَّهِ يُؤْتِيهِ مَنْ يَشَاءُ ‏‏ ‏.‏

It was narrated from 'Iyad bin Himar that the Messenger of Allah (ﷺ) said: “Whoever finds lost property, let him ask one or two men of good character to witness it, then he should not alter it nor conceal it. If its owner comes along, then he has more right to it, otherwise it belongs to Allah (SWT), Who gives it to whomsoever He wills.”

حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ، قَالَ خَرَجْتُ مَعَ زَيْدِ بْنِ صُوحَانَ وَسَلْمَانَ بْنِ رَبِيعَةَ حَتَّى إِذَا كُنَّا بِالْعُذَيْبِ الْتَقَطْتُ سَوْطًا فَقَالاَ لِي أَلْقِهِ ‏.‏ فَأَبَيْتُ فَلَمَّا قَدِمْنَا الْمَدِينَةَ أَتَيْتُ أُبَىَّ بْنَ كَعْبٍ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ أَصَبْتَ الْتَقَطْتُ مِائَةَ دِينَارٍ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلْتُهُ فَقَالَ ‏"‏ عَرِّفْهَا سَنَةً ‏"‏ ‏.‏ فَعَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا فَسَأَلْتُهُ فَقَالَ ‏"‏ عَرِّفْهَا ‏"‏ ‏.‏ فَعَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا ‏.‏ فَقَالَ ‏"‏ اعْرِفْ وِعَاءَهَا وَوِكَاءَهَا وَعَدَدَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ مَنْ يَعْرِفُهَا وَإِلاَّ فَهِيَ كَسَبِيلِ مَالِكَ ‏"‏ ‏.‏

It was narrated that Suwaid bin Ghafalah said: “I went out with Zaid bin Suhan and Salman bin Rabi'ah, and when we were at `Udhaib, I found a whip. They said to me: 'Throw it away,' but I refused. When we came to Al-Madinah I went to Ubayy bin Ka'b and told him about that. He said: 'You did the right thing. I found one hundred dinar that had been lost at the time of the Messenger of Allah (ﷺ), and I asked him about it. He said, “Announce it for a year.” So I Announced it, and I did not find anyone who recognized it. He said: “Remember the features of its bag and strap, and how many it contains, then announce it for a year. If someone comes who describes it with those features, (give it to him), otherwise it is like your own property.”

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا أَبُو بَكْرٍ الْحَنَفِيُّ، ح وَحَدَّثَنَا حَرْمَلَةُ بْنُ يَحْيَى، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، قَالاَ حَدَّثَنَا الضَّحَّاكُ بْنُ عُثْمَانَ الْقُرَشِيُّ، حَدَّثَنِي سَالِمٌ أَبُو النَّضْرِ، عَنْ بُسْرِ بْنِ سَعِيدٍ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، ‏.‏ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ ‏ ‏ عَرِّفْهَا سَنَةً فَإِنِ اعْتُرِفَتْ فَأَدِّهَا فَإِنْ لَمْ تُعْرَفْ فَاعْرِفْ عِفَاصَهَا وَوِعَاءَهَا ثُمَّ كُلْهَا فَإِنْ جَاءَ صَاحِبُهَا فَأَدِّهَا إِلَيْهِ ‏‏ ‏.‏

It was narrated from Zaid bin Khalid Al-Juhani that the Messenger of Allah (ﷺ) was asked about lost property. : He said: “Announce it for a year, then if someone describes it with its features, return it to him. If no one claims it, then remember the features of its leather bag and strap, and consume it (use it). Then if its owner comes along, give it to him.”

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ خَالِدِ بْنِ عَثْمَةَ، حَدَّثَنِي مُوسَى بْنُ يَعْقُوبَ الزَّمْعِيُّ، حَدَّثَتْنِي عَمَّتِي، قُرَيْبَةُ بِنْتُ عَبْدِ اللَّهِ أَنَّ أُمَّهَا، كَرِيمَةَ بِنْتَ الْمِقْدَادِ بْنِ عَمْرٍو أَخْبَرَتْهَا عَنْ ضُبَاعَةَ بِنْتِ الزُّبَيْرِ، عَنِ الْمِقْدَادِ بْنِ عَمْرٍو، أَنَّهُ خَرَجَ ذَاتَ يَوْمٍ إِلَى الْبَقِيعِ وَهُوَ الْمَقْبُرَةُ لِحَاجَتِهِ وَكَانَ النَّاسُ لاَ يَذْهَبُ أَحَدُهُمْ فِي حَاجَتِهِ إِلاَّ فِي الْيَوْمَيْنِ وَالثَّلاَثَةِ فَإِنَّمَا يَبْعَرُ كَمَا تَبْعَرُ الإِبِلُ ثُمَّ دَخَلَ خَرِبَةً فَبَيْنَمَا هُوَ جَالِسٌ لِحَاجَتِهِ إِذْ رَأَى جُرَذًا أَخْرَجَ مِنْ جُحْرٍ دِينَارًا ثُمَّ دَخَلَ فَأَخْرَجَ آخَرَ حَتَّى أَخْرَجَ سَبْعَةَ عَشَرَ دِينَارًا ثُمَّ أَخْرَجَ طَرَفَ خِرْقَةٍ حَمْرَاءَ ‏.‏ قَالَ الْمِقْدَادُ فَسَلَلْتُ الْخِرْقَةَ فَوَجَدْتُ فِيهَا دِينَارًا فَتَمَّتْ ثَمَانِيَةَ عَشَرَ دِينَارًا فَخَرَجْتُ بِهَا حَتَّى أَتَيْتُ بِهَا رَسُولَ اللَّهِ صلى الله عليه وسلم فَأَخْبَرْتُهُ خَبَرَهَا فَقُلْتُ خُذْ صَدَقَتَهَا يَا رَسُولَ اللَّهِ ‏.‏ قَالَ ‏"‏ ارْجِعْ بِهَا لاَ صَدَقَةَ فِيهَا بَارَكَ اللَّهُ لَكَ فِيهَا ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ لَعَلَّكَ أَتْبَعْتَ يَدَكَ فِي الْجُحْرِ ‏"‏ ‏.‏ قُلْتُ لاَ وَالَّذِي أَكْرَمَكَ بِالْحَقِّ ‏.‏ قَالَ فَلَمْ يَفْنَ آخِرُهَا حَتَّى مَاتَ ‏.‏

It was narrated from Miqdad bin 'Amr: That he went out one day to Al-Baqi', which is the graveyard, to relieve himself. People used to go out to relieve themselves only every two or three days, and their faces was like that of a camel (because of hunger and rough food). Then he entered a ruin and while he was squatting to relieve himself, he saw a rat bringing a Dinar out of a hole, then it went in and brought out another, until it had brought out seventeen Dinars. Then it brought out a piece of red rag.Miqdad said: “I picked up the rag and found another Dinar inside it, thus completing eighteen Dinar. I took them out and brought them to the Messenger of Allah (ﷺ), and told him what had happened. I said, 'Take its Sadaqah (charity), O Messenger of Allah (ﷺ).' He said: 'Take them back, for no Sadaqah is due on them. May Allah (SWT) bless them for you.' Then he said: 'Perhaps you put your hand in the hole?' I said: 'No, by the One Who has honored you with the truth.”

حَدَّثَنَا مُحَمَّدُ بْنُ مَيْمُونٍ الْمَكِّيُّ، وَهِشَامُ بْنُ عَمَّارٍ، قَالاَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدٍ، وَأَبِي، سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ ‏ فِي الرِّكَازِ الْخُمُسُ ‏‏ ‏.‏

It was narrated from Abu Hurairah that the Messenger of Allah (ﷺ) said: “One fifth is due on buried treasure.”

حَدَّثَنَا نَصْرُ بْنُ عَلِيىٍّ الْجَهْضَمِيُّ، حَدَّثَنَا أَبُو أَحْمَدَ، عَنْ إِسْرَائِيلَ، عَنْ سِمَاكٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ فِي الرِّكَازِ الْخُمُسُ ‏‏ ‏.‏

It was narrated from Ibn`Abbas that the Messenger of Allah (ﷺ) said: “One fifth is due on buried treasure.”

حَدَّثَنَا أَحْمَدُ بْنُ ثَابِتٍ الْجَحْدَرِيُّ، حَدَّثَنَا يَعْقُوبُ بْنُ إِسْحَاقَ الْحَضْرَمِيُّ، حَدَّثَنَا سُلَيْمَانُ بْنُ حَيَّانَ، سَمِعْتُ أَبِي يُحَدِّثُ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ ‏ كَانَ فِيمَنْ كَانَ قَبْلَكُمْ رَجُلٌ اشْتَرَى عَقَارًا فَوَجَدَ فِيهَا جَرَّةً مِنْ ذَهَبٍ فَقَالَ اشْتَرَيْتُ مِنْكَ الأَرْضَ وَلَمْ أَشْتَرِ مِنْكَ الذَّهَبَ ‏.‏ فَقَالَ الرَّجُلُ إِنَّمَا بِعْتُكَ الأَرْضَ بِمَا فِيهَا ‏.‏ فَتَحَاكَمَا إِلَى رَجُلٍ فَقَالَ أَلَكُمَا وَلَدٌ فَقَالَ أَحَدُهُمَا لِي غُلاَمٌ ‏.‏ وَقَالَ الآخَرُ لِي جَارِيَةٌ ‏.‏ قَالَ فَأَنْكِحَا الْغُلاَمَ الْجَارِيَةَ وَلْيُنْفِقَا عَلَى أَنْفُسِهِمَا مِنْهُ وَلْيَتَصَدَّقَا ‏‏ ‏.‏

Sulaiman bin Hayyan said: “I heard my father narrate from Abu Hurairah that the Prophet (ﷺ) said: 'Among those who came before you there was a man who bought some property and found therein a jar of gold. He said: “I bought land from you, but I did not buy the gold from you.” The man said: “Rather I sold you the land with whatever is in it.” They referred their case to (a third) man who said: “Do you have children?” One of them said: “I have a boy.” The other said: “I have a girl.” He said: “Marry the boy to the girl, and let them spend on themselves from it and give in charity.”

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، وَعَلِيُّ بْنُ مُحَمَّدٍ، قَالاَ حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ ذصلى الله عليه وسلم بَاعَ الْمُدَبَّرَ ‏.‏

It was narrated from Jabir that: the Messenger of Allah (ﷺ) sold a Mudabbar.

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ دَبَّرَ رَجُلٌ مِنَّا غُلاَمًا وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَاعَهُ النَّبِيُّ صلى الله عليه وسلم فَاشْتَرَاهُ ابْنُ النَّحَّامِ رَجُلٌ مِنْ بَنِي عَدِيٍّ ‏.‏

It was narrated that Jabir bin 'Abdullah said: “A man among us promised freedom to a slave after his death, and he did not have any property other than him (this slave). So the Prophet (ﷺ) sold him, and Ibn (Nahham), a man from Banu 'Adi, bought him.”

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَلِيُّ بْنُ ظَبْيَانَ، عَنْ عُبَيْدِ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏"‏ الْمُدَبَّرُ مِنَ الثُّلُثِ ‏"‏ ‏.‏ قَالَ ابْنُ مَاجَهْ سَمِعْتُ عُثْمَانَ - يَعْنِي ابْنَ أَبِي شَيْبَةَ - يَقُولُ هَذَا خَطَأٌ يَعْنِي حَدِيثَ ‏"‏ الْمُدَبَّرُ مِنَ الثُّلُثِ ‏"‏ ‏.‏ قَالَ أَبُو عَبْدِ اللَّهِ لَيْسَ لَهُ أَصْلٌ ‏.‏

It was narrated from Ibn`Umar that the Prophet (ﷺ) said: “The Mudabbar is part of the one third of the estate.”

حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ، قَالاَ حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا شَرِيكٌ، عَنْ حُسَيْنِ بْنِ عَبْدِ اللَّهِ بْنِ عُبَيْدِ اللَّهِ بْنِ عَبَّاسٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ أَيُّمَا رَجُلٍ وَلَدَتْ أَمَتُهُ مِنْهُ فَهِيَ مُعْتَقَةٌ عَنْ دُبُرٍ مِنْهُ ‏‏ ‏.‏

It was narrated from Ibn`Abbas that the Messenger of Allah (ﷺ) said: “Any man whose slave won an bears him a child, she will be free after he dies.”

Loading hadith 2536

حَدَّثَنَا أَحْمَدُ بْنُ يُوسُفَ، حَدَّثَنَا أَبُو عَاصِمٍ، حَدَّثَنَا أَبُو بَكْرٍ يَعْنِي النَّهْشَلِيَّ، عَنِ الْحُسَيْنِ بْنِ عَبْدِ اللَّهِ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ ذُكِرَتْ أُمُّ إِبْرَاهِيمَ عِنْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏.‏ فَقَالَ ‏ ‏ أَعْتَقَهَا وَلَدُهَا ‏‏ ‏.‏

It was narrated that Ibn`Abbas said: “Mention was made of the mother of Ibrahim in the presence of the Messenger of Allah (ﷺ), and he said: 'Her son set her free.'”

Loading hadith 2537

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، وَإِسْحَاقُ بْنُ مَنْصُورٍ، قَالاَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ، يَقُولُ كُنَّا نَبِيعُ سَرَارِينَا وَأُمَّهَاتِ أَوْلاَدِنَا وَالنَّبِيُّ صلى الله عليه وسلم فِينَا حَىٌّ لاَ نَرَى بِذَلِكَ بَأْسًا ‏.‏

Jabir bin `Abdullah was heard to say: “We used to sell our slave women and the mothers of our children (Umahat Awaldina) when the Prophet (ﷺ) was still living among us, and we did not see anything wrong with that.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَعَبْدُ اللَّهِ بْنُ سَعِيدٍ، قَالاَ حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، عَنِ ابْنِ عَجْلاَنَ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ ثَلاَثَةٌ كُلُّهُمْ حَقٌّ عَلَى اللَّهِ عَوْنُهُ الْغَازِي فِي سَبِيلِ اللَّهِ وَالْمُكَاتَبُ الَّذِي يُرِيدُ الأَدَاءَ وَالنَّاكِحُ الَّذِي يُرِيدُ التَّعَفُّفَ ‏‏ ‏.‏

حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ، وَمُحَمَّدُ بْنُ فُضَيْلٍ، عَنْ حَجَّاجٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ أَيُّمَا عَبْدٍ كُوتِبَ عَلَى مِائَةِ أُوقِيَّةٍ فَأَدَّاهَا إِلاَّ عَشْرَ أُوقِيَّاتٍ فَهُوَ رَقِيقٌ ‏‏ ‏.‏

It was narrated from `Amr bin Shu'aib , from his father, from his grandfather that the Messenger of Allah (ﷺ) said: “Any slave who has made a contract to buy his freedom for one hundread Uqiyyah and pays it all except ten Uqiyyah; he is still a slave.” (One Uqiyyah is equal to 40 Dirham.)

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ نَبْهَانَ، - مَوْلَى أُمِّ سَلَمَةَ - عَنْ أُمِّ سَلَمَةَ، أَنَّهَا أَخْبَرَتْ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَالَ ‏ ‏ إِذَا كَانَ لإِحْدَاكُنَّ مُكَاتَبٌ وَكَانَ عِنْدَهُ مَا يُؤَدِّي فَلْتَحْتَجِبْ مِنْهُ ‏‏ ‏.‏

It was narrated from Umm Salamah that the Prophet (ﷺ) said: “If anyone of you (women) has a Mukatab, and he has enough (wealth) to pay off (his contact of manumission), she must veil herself from him.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَعَلِيُّ بْنُ مُحَمَّدٍ، قَالاَ حَدَّثَنَا وَكِيعٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، زَوْجِ النَّبِيِّ صلى الله عليه وسلم أَنَّ بَرِيرَةَ أَتَتْهَا وَهِيَ مُكَاتَبَةٌ قَدْ كَاتَبَهَا أَهْلُهَا عَلَى تِسْعِ أَوَاقٍ فَقَالَتْ لَهَا إِنْ شَاءَ أَهْلُكِ عَدَدْتُ لَهُمْ عَدَّةً وَاحِدَةً وَكَانَ الْوَلاَءُ لِي قَالَ فَأَتَتْ أَهْلَهَا فَذَكَرَتْ ذَلِكَ لَهُمْ فَأَبَوْا إِلاَّ أَنْ تَشْتَرِطَ الْوَلاَءَ لَهُمْ فَذَكَرَتْ عَائِشَةُ ذَلِكَ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ ‏"‏ افْعَلِي ‏"‏ ‏.‏ قَالَتْ فَقَامَ النَّبِيُّ صلى الله عليه وسلم فَخَطَبَ النَّاسَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ ‏"‏ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ كُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ كِتَابُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ وَالْوَلاَءُ لِمَنْ أَعْتَقَ ‏"‏ ‏.‏

It was narrated from Hisham bin 'Urwah, from his father, about 'Aishah the wife of the Prophet (ﷺ) - : that Barirah came to her when she was came to her when she was Muktabah, and her masters had written a contract of manumission for nine Uqiyyah. She (`Aishah) said: “If your masters wish I will pay them that in one sum, and the right of inheritance will belong to me.” He said: “So she went to her masters and told them about that, but they insisted that the right of inheritance should belong to them. `Aishah mentioned that to the Prophet (ﷺ) and he said: 'Do it.' Then the Prophet (ﷺ) stood up and addressed the people. He praised and glorified Allah (SWT), then he said: 'What is the matter with some people who stipulated conditions that are not in the Book of Allah (SWT)? Every conditions that is not in the Book of Allah (SWT) is invalid, even if there are one hundred conditions. The Book of Allah(SWT) is more deserving of being followed and the conditions of Allah (SWT) are more binding. And the Wala belongs to the one who manumits (the slave).”

حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ عَمْرِو بْنِ مُرَّةَ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ شُرَحْبِيلَ بْنِ السِّمْطِ، قَالَ قُلْتُ لِكَعْبٍ يَا كَعْبَ بْنَ مُرَّةَ حَدِّثْنَا عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم وَاحْذَرْ ‏.‏ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ ‏ مَنْ أَعْتَقَ امْرَأً مُسْلِمًا كَانَ فِكَاكَهُ مِنَ النَّارِ يُجْزِئُ بِكُلِّ عَظْمٍ مِنْهُ عَظْمٌ مِنْهُ وَمَنْ أَعْتَقَ امْرَأَتَيْنِ مُسْلِمَتَيْنِ كَانَتَا فِكَاكَهُ مِنَ النَّارِ يُجْزِئُ بِكُلِّ عَظْمَيْنِ مِنْهُمَا عَظْمٌ مِنْهُ ‏‏ ‏.‏

It was narrated that Shurahbil bin Simt said: I said to Ka'b bin Murrah, tell us a Hadith from the Messenger of Allah (ﷺ), but be careful. He said: I heard the Messenger of Allah (ﷺ) say: “Whoever frees a Muslim man, he will be his ransom from the Fire; each of his bones will suffice (as a ransom) for each of his bones. Whoever frees two Muslim women, they will be his ransom from the Fire; each of their two bones will suffice (as a ransom) for each of his bones.”

حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ أَبِي مُرَاوِحٍ، عَنْ أَبِي ذَرٍّ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أَىُّ الرِّقَابِ أَفْضَلُ قَالَ ‏ ‏ أَنْفَسُهَا عِنْدَ أَهْلِهَا وَأَغْلاَهَا ثَمَنًا ‏‏ ‏.‏

It was narrated that Abu Dharr said: “I said: 'O Messenger of Allah (ﷺ), which slave is best?' He said: ‘The one who is most precious to his master and most valuable in price.' ”

حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ، وَإِسْحَاقُ بْنُ مَنْصُورٍ، قَالاَ حَدَّثَنَا مُحَمَّدُ بْنُ بَكْرٍ الْبُرْسَانِيُّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، وَعَاصِمٍ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدُبٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ ‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ ‏‏ ‏.‏

It was narrated from Samurah bin Jundub that the Prophet (ﷺ) said: “Whoever becomes the master of a Mahram relative (with whom marriage is not lawful), he becomes free.”

Loading hadith 2545

حَدَّثَنَا رَاشِدُ بْنُ سَعِيدٍ الرَّمْلِيُّ، وَعُبَيْدُ اللَّهِ بْنُ الْجَهْمِ الأَنْمَاطِيُّ، قَالاَ حَدَّثَنَا ضَمْرَةُ بْنُ رَبِيعَةَ، عَنْ سُفْيَانَ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ ‏‏ ‏.‏

It was narrated from Ibn`Umar that the Messenger of Allah (ﷺ) said: “Whoever becomes the master of a Mahram relative, he becomes free.”

Loading hadith 2546

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُعَاوِيَةَ الْجُمَحِيُّ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ سَعِيدِ بْنِ جُمْهَانَ، عَنْ سَفِينَةَ أَبِي عَبْدِ الرَّحْمَنِ، قَالَ أَعْتَقَتْنِي أُمُّ سَلَمَةَ وَاشْتَرَطَتْ عَلَىَّ أَنْ أَخْدُمَ النَّبِيَّ صلى الله عليه وسلم مَا عَاشَ ‏.‏

It was narrated from that Safinah - Abu 'Abdur-Rahman-said : “Umm Salamah freed me but stipulated that I should serve the Prophet (ﷺ) as long he lived.”

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، وَمُحَمَّدُ بْنُ بِشْرٍ، عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ النَّضْرِ بْنِ أَنَسٍ، عَنْ بَشِيرِ بْنِ نَهِيكٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي مَمْلُوكٍ أَوْ شِقْصًا فَعَلَيْهِ خَلاَصُهُ مِنْ مَالِهِ إِنْ كَانَ لَهُ مَالٌ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ اسْتُسْعِيَ الْعَبْدُ فِي قِيمَتِهِ غَيْرَ مَشْقُوقٍ عَلَيْهِ ‏‏ ‏.‏

It was narrated from Abu Hurairah that the Messenger of Allah (ﷺ) said: “Whoever frees his share of a slave or part of his share, must pay from his wealth if he has any wealth if he has any wealth (in order to buy the rest of the slave's freedom). If he does not have wealth, then the slave should be asked to work for the price (of his freedom), without that causing him too much hardship.”

حَدَّثَنَا يَحْيَى بْنُ حَكِيمٍ، حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ ‏ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ بِقِيمَةِ عَدْلٍ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ إِنْ كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ‏‏ ‏.‏

It was narrated from Ibn`Umar that the Messenger of Allah (ﷺ) said: “Whoever frees his share of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price to the other co-owners), if he has enough wealth to do so. Otherwise, he will have freed whatever he freed.”
